Noon Pacific

Terms of Use

Last updated October 18, 2026

These terms cover your use of noonpacific.com, its emails, and anything else we run under the Noon Pacific name (together, “Noon Pacific”). Noon Pacific is run by Clark Dinnison, an individual based in Newport Beach, California (“we”, “us”). By using Noon Pacific, creating an account, or paying for a sponsorship, you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use Noon Pacific.

Recommendations are opinions

Noon Pacific is a personal collection of songs, places, objects and software that we like. Everything we feature is shared as personal opinion, for general interest only. It is not professional, financial, safety, travel, medical or legal advice, and it is not a guarantee, warranty or endorsement of any product, place, business, person or service.

We don’t make, sell, rent, operate or support anything we feature, and we don’t check that it is safe, legal, accurate, available, suitable for you, or as described. Prices, availability, hours, listings, descriptions and links change, and what you see here may be out of date. Always check the details with the seller, host or maker yourself.

Purchases and visits are between you and them

If you buy, book, rent, download, install, subscribe to, visit or use anything you found through Noon Pacific, that transaction and that use are solely between you and the third party that provides it, under their terms. We are not a party to it and we are not responsible for it, including for its price, quality, safety, delivery, refunds, privacy or any loss, injury, damage or dispute that results.

Places can involve real-world risks such as travel, weather, terrain, water, wildlife and other people. Software can contain bugs or cause data loss. Products can be defective. You use, visit and rely on anything featured here entirely at your own risk and judgment.

Links, embedded players and maps on Noon Pacific come from other services (for example Spotify, YouTube, SoundCloud, Bandcamp and Mapbox). We don’t control them and aren’t responsible for their content, availability or practices.

Sponsorships and how we get paid

Some collections are presented by a sponsor, and they are labeled “Presented by” wherever they appear. Sponsors pay for that credit. Sponsors don’t choose, review or approve what goes into a collection, and a sponsorship is not an endorsement of the sponsor by us, or of us by the sponsor. We don’t earn affiliate commissions on the things we feature.

Your account

You need to be at least 13 to create an account. Keep access to your email account secure, since signing in works through email links or Google. You are responsible for what happens under your account. Membership numbers and join dates are assigned by us and can’t be transferred or sold.

If you joined our mailing list before 2021, we created your account from that subscription so you keep your original join date. You can unsubscribe from email at any time, or ask us to delete your account (see the Privacy Policy).

What you share with us

You may add a handle and photo, save things, and submit links. Only share what you have the right to share, and nothing unlawful, infringing, hateful, harassing, sexually explicit or misleading. You keep ownership of what you submit, and you give us a worldwide, royalty-free, non-exclusive license to use, display, edit and publish it in connection with Noon Pacific. We may remove anything, decline any submission, or reclaim any handle at our discretion. We don’t owe you anything for featuring something you suggested.

Acceptable use

Don’t misuse Noon Pacific: no scraping or bulk downloading, interfering with or probing the service, getting around limits, impersonating anyone, creating accounts in bulk, or using it for anything unlawful. We may suspend or close accounts that do.

Sponsoring a collection

When you reserve a sponsorship, you authorize a hold on your card for the price shown. A hold is not a charge. We review every reservation and may decline any of them for any reason, in which case the hold is released and you are not charged. If we approve it, the card is charged the price shown.

A sponsorship is a “Presented by” credit with your name, logo and link on that collection’s page and in its email, as described when you reserve. It stays on the collection for as long as Noon Pacific publishes that collection; we don’t guarantee that the service, a page or an email will continue indefinitely. We don’t promise any number of views, clicks, sales or other results. Placement, design and timing are ours to decide.

Sponsorships are non-refundable once approved, with one exception: if the sponsored collection isn’t published within 30 days after its scheduled date, you get a full refund on request. You confirm that you have the right to use the name, logo, link and handles you give us, that they aren’t misleading or unlawful, and that we may display them. We may remove a credit that becomes unlawful, harmful or misleading, in which case we decide whether any refund is due.

The Scout program

Scouts may earn a share of sponsorship sales that come through their link, at the rate shown on their Scout page. A sale counts for the last Scout link the buyer used within 30 days. Buying through your own link doesn’t count. A share is booked only when a sale is approved and charged, it is cancelled if the sale is refunded, and it is paid by hand on terms we arrange with you by email. Scouts are independent, not our employees, agents or partners, and may not make promises on our behalf or promote Noon Pacific in a misleading way, by spam, or by paid ads on our name. We may change or end the program, or remove a Scout, at any time; shares already earned under these terms will still be paid. You are responsible for any taxes on what you earn.

Our content

The selection, writing, design and code of Noon Pacific are ours or licensed to us. Music, images, product names and logos belong to their owners and are shown to identify and credit them. You may share links to Noon Pacific freely; don’t copy or republish its content in bulk without permission. If you believe something here infringes your rights, email us at legal@noonpacific.com and we’ll look at it promptly.

No warranties

Noon Pacific is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy and uninterrupted or error-free operation.

Limits on our liability

To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, or for personal injury or property damage, arising from or related to Noon Pacific, anything featured on it, or any third party, even if we were told it might happen.

Our total liability for any claim relating to Noon Pacific is limited to the greater of $100 or the amount you paid us in the 12 months before the claim arose. Some places don’t allow certain of these limits, so they apply to you only as far as the law permits.

Indemnity

You agree to defend, indemnify and hold us harmless from any claims, losses, liabilities and expenses (including reasonable legal fees) arising from your use of Noon Pacific, anything you submit or provide to us, your dealings with any third party you found through Noon Pacific, or your breach of these terms.

Changes and ending things

We may change Noon Pacific, or stop running all or part of it, at any time. We may update these terms; when we do, we’ll change the date above, and if a change is significant we’ll let members know. Continuing to use Noon Pacific after an update means you accept it. You can stop using Noon Pacific at any time, and we may suspend or end your access if you break these terms.

Law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Orange County, California, and you and we consent to their jurisdiction. If any part of these terms is found unenforceable, the rest stays in effect. Not enforcing a term isn’t a waiver of it. These terms are the whole agreement between you and us about Noon Pacific.
